 The oral arguments for Hannah’s appeal in the 13th Court of Appeals were held on Nov. 6th. We are confident that the three judge panel heard the significant issues and will make the proper ruling soon. Thank you for your continued interest and support.

Our Purpose

From the 20/20 InterviewThis site was created for Hannah Overton and is intended to be a source of truth about her and her wrongful conviction.  Hannah is a 30 year old mother of five who was convicted in September, 2007 of capital murder in the death of Andrew Burd, the four year old child that she and her husband Larry were adopting from the foster system.

 

We who know Hannah is innocent are committed to her exoneration and freedom.  We are also committed to shedding light on the widespread problems in our justice system that have been made evident to us through Hannah's case.

 

We are a Christian community.  We welcome all who support Hannah, truth, and justice.

Kenda's Update: August 17th

Psalm 37:5-6  Commit your way to the Lord, Trust also in Him, And He shall bring it to pass. He shall bring forth your righteousness as the light, and your justice as the noonday.

Well, our visit was good, as always! There is a lot of ministry going on in her dorm and the Spirit is really moving. Hannah is also receiving from the new believer's. How awesome that God's Spirit is available to all who are believers and of a willing heart. The Bill Glass Ministry should be coming into her unit at the end of this month, please keep this in prayer. She is of course really missing the kids, and knows they are missing her. Larry and Hannah just celebrated 11 years of marriage and were able to see each other on their anniversary. Hannah had her hair in little braids to "dress up" for their "date". Now, unfortunately this visit was cut short by an error on the part of the guard! They were both very disappointed that they got less than 2 hrs together! God has continually reaffirmed His scriptures to her and she continues to cling to Him and live out His promises and truth! Praise the Lord for the approval of oral arguments on Sep. 11th. May this season end soon!  Psalm 61

Update on Larry Overton's Case

Let us rejoice that Larry will never have to go to trial! He has pleaded "no contest" in the case against him. He has been given a five year probation and a $5,000 fine. After 1 year and 11 months he can petition the court to drop all conditions and be free of probation as well. He was given deferred adjudication - which means that this will not be on his permanent record. He did not say he was guilty of anything. The local DA has said that because of evidence or a lack of evidence against Larry, the charge of capital murder has been dropped.

We can thank the Lord that he will never have to go to trial over this!

CORPUS CHRISTI, Texas— As newlyweds in 1997, neither Hannah Overton nor her husband Larry wanted to move back to this port city. Both had grown up here, but Hannah wanted to do missionary work abroad and Larry remembered as a kid how its churches were disunited. Yet they thought God wanted them back—perhaps to unify the city, though they couldn't say how. Disobeying God, they agreed, was worse than living in Corpus Christi. They moved into a house on the south end of town that Larry remodeled. They started a family that now includes five children born to them.

From the beginning, the case of my daughter, Hannah Overton, has been tried not only in the courts, but also inaccurately in the media.

I want to set the record straight.

First, Hannah suffered the loss of a child from a tragic accident. She had welcomed Andrew with open arms as her son. She had the same hopes and dreams for him that she has for all the children in her family. Anyone who has lost a child can tell you it is a blow from which you never fully recover.

But to add to her agony, before she had the slightest chance to process her unspeakable grief, she was besieged by the false accusations that she had murdered her son.

A layman’s look at the current motions

Not just going through the motions

The motions for a “new trial” and “arrest of judgment” in many cases are formalities when such a harsh sentence has been handed down.  In this case they are real issues.  The issues with the motion for arrest of judgment Several things are at issue. 

  • First of all you cannot send someone to jail for life without the possibility of parole for what equates to first degree pre-meditated murder when you prove no intent.  Remember the prosecutions reasoning for Hannah not seeking medical attention was “just losing it.”  From my simple, non-legal, mind I have a hard time seeing someone not doing something by just losing it.  Acts of violence are done when someone just loses it, not acts of delay, treating symptoms and then rushing to the hospital.   There were no witnesses who stated that Hannah ever “just lost it,” most of the testimony stated that she seemed too calm during the whole event.  Just losing it does not fit with the prosecutions accusations.

  • Secondly you must prove beyond a reasonable doubt that Hannah intended to murder Andrew by knowingly delaying seeking medical attention and knowing that that delay would cause the death of Andrew.  No such proof was ever given.  The facts point to Hannah treating symptoms which could be attributed to a multitude non-life threatening illnesses or reactions.  She then rushed to the hospital, leaving her home within an hour and a half from the time the first symptoms appeared in Andrew.  If you add this to the fact that the jury did not find Hannah guilty of poisoning Andrew, at most you have a terrible accident.
